rules based on Number of transit, peering, bandwidth, and number of customer
are technical and non-discriminatory I think
If there are written and strict, there is no problem

Only in v4.
But v4 is not made for renumbering.
Renumbering is quite difficult when you are not READY to do it.
If you build your network with renumbering in mind, it can help.
And v6 has a lot of nice mecanisms to help renumbering
