The disfavored status within international law of
unilateral state-based regulations that target
extraterritorial actors arises from the inherent challenges
such actions represent to state sovereignty. In the context
of the Internet, the complexity of choiceof-law analysis is
heightened: regulations imposed by one state have the
potential to effectively block communications to citizens
of all states and undermine the conflicting regulatory aims
of neighboring states. Early legal commentators built upon
this cascading chilling effect of state-based regulation to
proclaim both the futility and illegitimacy of state-based
action in the online environment. Subsequent scholars have
demonstrated the commensurability of state-based online
regulation and the existing framework of international
jurisdiction and choice-of-law analysis. However, having
solved the jurisdictional puzzle and established the
legitimacy of extraterritorial regulatory responses to
local harm that originates abroad, these commentators have
either left untouched or downplayed the impact of
unilateral regulations in a networked environment.
According to their assessments, the “spillover” impact of
unilateral cyberspace regulation will not differ
significantly from the impact of competing claims to
regulate a single activity in real space. In apparent
support for this position, recent technological
developments that promise to geographically inscribe
borders onto the Internet have been proclaimed as the
harbinger of fullfledged state-based regulation and the end
of the theoretical debate. This Article challenges the
now-conventional assertion that in an era of bordering
technologies the impact of unilateral regulatory moves in
the online world can be effectively cabined.

The Internet is a truly global medium, especially in the
realm of electronic commerce. Thus, the Internet has been
the source of many new legal and social issues facing the
global community. The availability of personal data on the
Internet, due considerably to the rapid increase in
commercial activity on the medium, has caused an increase
in cases of “identity theft.” Identity theft occurs when
thieves use personal or financial information about a
person (the victim) to create a fake identity for
themselves in order to obtain money from either the victim
or various other institutions.8 Identity thieves use the
Internet as a weapon against individual consumers by taking
personal and financial information, such as credit card
numbers and social security numbers, and then using that
information to, among other things, purchase products or
launder money. Such a scheme can be devastating for an
identity theft victim and can create financial costs for
credit card companies and other commercial entities.

Cybercrime’s Scope: Interpreting “Access” and
“Authorization” in Computer Misuse Statutes by Orin S. Kerr
The federal government, all fifty states, and dozens of
foreign countries have enacted computer crime statutes that
prohibit “unauthorized access” to computers. No one knows
what it means to “access” a computer, however, or when
access becomes “unauthorized.” The few courts that have
construed these terms have offered widely varying
interpretations. Several recent decisions suggest that any
breach of contract renders an access unauthorized, broadly
criminalizing contract law on the Internet. In this
Article, Professor Orin Kerr explains the origins of
unauthorized access statutes, and examines why the early
beliefs that such statutes articulated a clear standard
have proven remarkably na¨ive. He then shows how and why
the courts have construed these statutes in an overly broad
manner that threatens to criminalize a surprising range of
innocuous conduct involving computers. Finally, Professor
Kerr offers a normative proposal for interpreting “access”
and “authorization.” Courts should reject a contract-based
theory of authorization, and should limit the scope of
unauthorized access statutes to circumvention of code-based
restrictions on computer privileges. This proposed
interpretation best mediates between securing privacy and
protecting the liberty interests of Internet users. It also
mirrors criminal law’s traditional treatment of consent
defenses, and avoids possible constitutional difficulties
that may arise under the broader constructions that courts
have recently favored.
