RE: Nudist Magazines With Photos of Kids Not Obscene or Lewd, Says 3rd Circuit...

Hi all

Apologies, I missed posting this comment from our very own Peng Hwa
Ang which precedes the David Kerr comment I posted earlier. To avoid
too much confusion, both are reproduced below.

Cheers

 David,

In principle, the outcome makes sense. There are horror stories in
the US of parents thrown into prison because they took pictures of
their kids stepping out of the bathtub. An over-enthusiastic photo
developer reported the "porn" to the police.

Having said that, I'm also reminded of the exception generally
granted to nudity in medical settings. Apparently for a while, (again
in the USA, where else) there were hardcore porn vidoes trying to
disguise themselves medical training video. At the end of the video,
a man with a white long coat and a stethoscope would come on and he
would say, "And so, the nymphomaniac was not cured."

1) from a hotline perspective (certainly IWF) we are very careful to
try to distinguish - and not classify as child porn - family pictures
or naturist pictures which are innocently posed. Even when they are
re-transmitted into a recognised child-porn group context - this
latter case bothers me a bit, but we have to consider potential court
cases which will be defended in relation to a specific image
irrespective of the context.

 2) RSACi has always distinguished nudity and sex as categories. Our
research, and other peoples, in the UK, Europe and further afield
shows that some people associate nudity with sex but others make a
distinction. Separate descriptors in the new ICRA system will allow
the consumer to play it either way according to their values - which
is a major advantage of PICS based systems.
